The father did not think ahead, to see what consequences could result from his illegal actions. Hence, methinks he's already lost this battle--the one where his objective is to successfully assist in the proper raising of his daughter. It certainly is a sad situation, but not one he didn't bring upon himself & his daughter through his own choices, in my opinion.
