No, the little girl didn't choose. But her father chose for her in this situation, in my opinion.

"Don't do the crime if you can't do the time." This quote takes on a more ominous meaning in light of this situation, does it not?

Making him stay where he is doesn't serve any purpose? Why is he behind prison walls to begin with?

The general who wins the battle makes many calculations in his temple before the battle is fought. The general who loses makes but few calculations beforehand. - Sun Tzu
The father did not think ahead, to see what consequences could result from his illegal actions. Hence, methinks he's already lost this battle--the one where his objective is to successfully assist in the proper raising of his daughter. It certainly is a sad situation, but not one he didn't bring upon himself & his daughter through his own choices, in my opinion.
If you know the enemy and yourself you need not fear the results of a hundred battles. - Sun Tzu

He got out to see her, she was comatose by the time he arrived but her breathing changed once he was present.

Hopefully he'll give more thought to the consequences of his actions from now on.

Sad, sad situation--no matter how you look at it.
