A TEAM from the Government Service Insurance System (GSIS) has inspected the damage that was caused by a fire inside the Supreme Court's session hall on Monday, a representative from the Office of the Chief Justice said Tuesday. Midas Marquez said the team would be drafting an evaluation report before reconstruction could start. "We have to wait for the GSIS evaluation report before proceeding with the plans of rehabilitating the session hall," Marquez said. Funds from the rehabilitation will come from GSIS funds -- being the high court's insurer.

This is the first time that the high court's session hall had caught fire. A few years back, the Department of Justice (DoJ) had also caught fire, and was prevented from spreading to the Supreme Court. Marquez could not give an immediate estimate of the damage. "But I don't think it’s much because it’s only water damage and only one curtain caught fire," he said. The fire however failed to disrupt court activities, with the justices holding their first en banc session for this year at their lounge on the seventh floor."The en banc room is intact but it's still wet so they temporarily moved to the 7th floor," Marquez said. Meanwhile, oral arguments on a land dispute in Quezon City on January 30 will push through and will be held at the high court's session hall at its old building along Taft Avenue in Manila, said Marquez.

A fire hit the Supreme Court (SC) session hall in Ermita, Manila yesterday. Initial reports from the Manila Fire Department showed that the blaze started at 4 p.m. inside the session hall. Nobody was reported hurt by the fire, which damaged the facility.


Supt. Pablito Cordeta, MFD Fire Marshal, said that the fire was due to faulty electrical wiring in the ceiling of the session hall. He said a spark ignited a flame which quickly spread towards the ceiling and walls and curtains of the session hall. Cordeta said that the fire was put out at 4:40 p.m. by 15 firetrucks. A portion of Padre Faura St. in Ermita was closed to traffic for responding firetrucks. Cordeta said that despite the damage it sustained, the session hall could still be repaired and restored. Arson probers are now conducting mopping-up operations. (Rizal S. Obanil)

Faulty electrical wiring sparked a one-hour fire at the Supreme Court that partly damaged the session hall and tied up traffic along Padre Faura Street and Taft Avenue in Manila yesterday.

Superintendent Pablito Cordeta, Manila Fire Department marshal, said the fire started around 3:52 p.m. at the newly refurbished session hall, located on the second floor. Chief Justice Reynato Puno said he was in a meeting in the building when the fire began.

"I was in a meeting in the en banc conference room when I saw smoke coming out from the flooring. Immediately we went out of the room and that’s when the alarm went off," he told reporters. Cordeta said it was fortunate that the fire occurred during office hours and not in the evening when the building was empty with no one to notice the blaze. Puno assured that records of court cases were safe.

He said no records were damaged during the incident. “It was an electrical short circuit that sparked the fire,” he told reporters, noting the presence of highly combustible curtains. At least six fire trucks rushed to the site. According to him, the fire gutted the en banc session hall, with the flames reaching the ceiling and perimeter wall. This prompted the evacuation of the employees and staff of the high court justices. No casualty was reported by arson probers.

“There is only minimal damage to the structures,” observed Cordeta. In an interview, Chief Justice Reynato Puno said they were in conference at the time.“It started when we were having a meeting. The smoke came from one of the conference rooms,” said Puno, who was presiding over the briefing by the Office of the Court Administrator. ABRA Rep. Luis Bersamin Jr. and his police bodyguard were shot dead by two gunmen yesterday after the lawmaker attended a niece’s wedding at Mt. Carmel Church in New Manila, Quezon City. The 62-year-old Bersamin, a member of President Macapagal-Arroyo’s party Kabalikat ng Mamamayang Pilipino (Kampi), had just left the church on Doña Juana Rodriguez (formerly Broadway) Avenue and was walking back to his car when attacked. Justice Lucas Bersamin, the lawmaker’s younger brother, declined a TV crew’s request for comment.

Bersamin’s murder came more than a month after a relative, Abra provincial board member James Bersamin, 66, was shot dead in the capital Bangued. Family members said the lawmaker had just stood as a sponsor at the marriage of his niece Pia, daughter of Justice Bersamin, to Niño Embuscado and was on his way to the reception when he was gunned down at around 5:25 p.m.“It was the recessional and everyone was going out of the church when we heard gunshots,” said Alvin Salonga, a guest at the wedding.

Judge Floro met Judge Apolinario Bruselas, as PJA 2nd highest officer, 2004. As RTC Judge Q.C., Philippines, the latter apologized to Judge Floro per text message on Judge Romeo F. Barza’s humiliation of Judge Floro. The latter prayed for the appointment to the Court of Appeals of Judge Bruselas. When Justice Bruselas was appointed CA Justice the latter introduced Judge Floro to the most powerful CA Justice Lucas Bersamin. The agenda was for the latter to help Judge Floro find a job thru Malacanang. Judge Floro also PLEADED to Justice Lucas for the latter to intervene and convince his S.C. Surprisingly, about 3 meetings between Judge Floro and Justice Lucas Bersamin discussed instead (of job) the a) talk between him and a staff of Justice Nazario, as ponente, circa January, 2006 b) the developments of Judge Floro’s case, and the last accidental meeting was c) at the CA g/f, where Justice Bersamin hurriedly went up but signaled his thumbs up right hand to Judge Floro, saying that J. Nazario is favourable to Judge Floro; and Justice Bersamin and J. Nazario met and talked about Judge Floro’s case, and she read the internet posts of Judge Floro. After that meeting, Justice Bruselas and Judge Floro talked for about 20 minutes regarding the filing of disbarment case against C.J. Davide, and Judge Floro’s plea to Justice Bruselas for help regarding a JOB. Judge FLORO candidly informed Justice Bersamin of the IMPRECATION or curse upon the judiciary, and specifically added, is the curse upon ATENEO class 1982, where Judge Floro accurately predicted the fire roasting death of the wife and Marilou, daughter of Dep. BEGINNING this Sunday, three dwarves will work their powers against 14 of the 15 justices of the Supreme Court, a dismissed judge has warned as he filed his third motion for reconsideration for his reinstatement before the high tribunal.
Judge Florentino Floro Jr. of the Malabon regional trial court was separated from service after medical findings showed that he was suffering from psychosis.

The high court had said that Judge Floro lacked the judicial temperament and the fundamental requirements of competence and objectivity expected of all judges. It said that the findings of psychosis by the mental health professionals assigned to his case indicated gross deficiency in competence and independence. In his appeal, Floro said his three dwarf-friends -- Luis, Armand, and Angel -- appeared to him last week and told him that the justices would suffer their wrath for dismissing him. Floro said the sufferings of the Supreme Court justices would start midnight of November 5, the eve of his 53rd birthday. Floro said he appealed to his dwarf-friends to spare one justice, which according to him had been put into a vote by the three. Floro did not name him. "Voting en banc with full authority, Luis voted negative, Armand conditionally positive, upon full appointment of Judge Floro to a higher or equal position by virtue of the eliminated magistrate, while Angel voted neutral," Floro said.
Because the voting was a tie, Floro said Luis agreed to spare one justice if he would spread oil on any part of the justice's house before November 5.

Floro said he would follow the dwarves' advice and start praying every Friday so that the curse on the justices would work. "I will devote my entire life, Fridays, until my last breath, towards the fulfillment, execution, and coming to pass of this curse. With absolute faith in Luis, Armand and Angel -- Angels of God, I will fulfill my destiny: spell and karma upon them, all their loved ones, up to the 4th generation," Floro said.
Judge Floro, who was appointed RTC Judge in November 1998, has admitted to having “psychic visions,” of having the ability to predict the future because of his power in “psychic phenomenon.” He said he believed in “duwendes” [dwarves] and forged a covenant with them. He also said that he could write while in a trance and that he had been seen by several people to have been in two places at the same time.
He also likened himself to the “angel of death” who could inflict pain on people, especially upon those he perceived to be corrupt officials of the Malabon RTC.
During court sessions, Judge Floro wore blue robes except on Fridays when he would wear a black robe and black outfit from head to foot allegedly to recharge his psychic powers. He also conducted healing sessions inside his chambers during breaks.

"MORE lawyers nowadays complain of corruption in the judicial system compared to 10 years ago, according to the Social Weather Stations. One out of two lawyers knows of a trial judge in their city or province who has taken a bribe but they did not report it because they could not prove it, said the SWS. In a briefing among lawyers Tuesday night, SWS president Mahar Mangahas said the perception of corruption in the various courts -- from the municipal trial courts all the way up to the Supreme Court -- has risen among lawyers in the last 10 years. "Our lawyers are more critical now than before," Mangahas told the lawyers as he presented the survey findings for the first time. The SWS polled 889 trial judges -- or 61 percent of all trial judges in the country -- and 400 lawyers from November 2003 to July 2004 to get their perceptions on various aspects of the judicial system.The last such survey was undertaken by SWS from 1994 to 1996.

"Corruption remains a major problem," the SWS said in a press statement."As in 1995, one-fourth of present lawyers say that many or very many judges are corrupt. Although half or 49 percent say they know a case in their own city or province where a judge took a bribe, only 8 percent said they reported the bribery. The main excuse of those who kept silent is that they could not prove it," the SWS said.Among judges, only 7 percent said that many or very many judges were corrupt.The SWS said the judges' perception of the extent of corruption among court personnel was the same as in 1996."What has increased is the proportion of judges seeing many lawyers as corrupt," it said.
Mangahas said the survey showed that corruption "remains a serious problem in the judicial system but it is not cultural.” "They're saying there's nothing to be done about (corruption) but it's not accepted. There's still the idealism," he said."

well, due to our slow internet here, i have to copy paste many long posts for sure upload

the story is so simple:

from 1901 until today, our supreme court buildings were never burned during the 2 world wars
but on jan 15 2007
it's session hall was burned and the logo (the emblem) of the court was cut into half, a half was well-preserved

this happened after i was dismissed or separated as judge due to alleged consulting the 3 dwarves
this was followed by deaths
principally before and after i wrote the court about the IMPRECATION or curse of these 3, on nov. 5 my 53rd birthday

so after this, nov. 3,

The killers of Judge Nathaniel Patugalan of Baggao, Cagayan had placed him under surveillance before they carried out the second attack on the judge who was shot dead last Friday night near the Quezon Memorial Circle in Quezon City, police probers disclosed yesterday.

Senior Superintendent Magtanggol Gatdula, Quezon City police director, said the two unidentified assassins have apparently established the daily routine of Patugalan who took a passenger jeepney at the corner of Elliptical Road and Commonwealth Ave. at around 6:30 p.m. when the victim was shot by one of the motorcyle-riding suspects.

Patugalan, 60, of the Baggao Regional Trial Court in Cagayan, died at the East Avenue Medical Center due to a gunshot wound in the right side of the body.

Gatdula said Patugalan’s relatives reported that several men had been seen casing their rented house on San Francisco Del Monte in Quezon City.

Gatdula said this is the second time that Judge Patugalan was ambushed. In the first attempt, he survived but his driver was killed and that was the reason that he sought his transfer to the Quezon City Metropolitan Trial Court.

It was learned that Patugalan had requested to be assigned to Quezon City after receiving death threats in Cagayan.

Patugalan used to handle sensitive cases against policemen in Bugging also in Cagayan. Patugalan was ambushed in October 2005 also in Baggao, Cagayan. He survived the incident but his driver died.

"We are looking into the cases he handled in Cagayan, the killers may have feared that his return may affect the cases," Gatdula said.

He said the QCPD is now closely working with the PNP regional command in Cagayan for the early resolution of the case.

Chief Justice Renato Puno, who was with Quezon City Mayor Feliciano Belmonte Jr. at the Quezon City Sports Club, was one of the first persons informed about the death of Patugalan.

Belmonte immediately ordered Gatdula to investigate the case.

The police, however, have not yet established the identity of any of the suspects because none of the passengers or even the driver of the jeepney, where Patugalan was shot, could provide any description of the suspects.

Probers said that according to Patugalan’s daughter Lian Dugusen, a reporter of the tabloid People’s Tonight, her father had requested the Supreme Court for his transfer to Metro Manila even temporarily because of the threat to his life in Cagayan.

Despite the government’s pronounced campaign to put a stop to the spate of killings of leftist activists, local officials and journalists, a judge and a leader of a Left-leaning militant group were added to the list of those slain after they were separately assassinated over the weekend, police reported yesterday.

The police said motorcycle-riding gunmen shot dead judge Nathaniel Patugalan just as he was about to board a minibus in Manila late Friday.

In another incident, university professor Jose Maria Cui, a leader of the leftist Bayan Muna (Nation First) political party, was gunned down while giving a class in the Northern Samar province capital city

The number has shocked the Roman Catholic church, Amnesty International and the European Union, prompting them to call on President Arroyo to stop the killings.

ABRA Rep. Luis Bersamin Jr. and his police bodyguard were shot dead by two gunmen yesterday after the lawmaker attended a niece’s wedding at Mt. Carmel Church in New Manila, Quezon City. The 62-year-old Bersamin, a member of President Macapagal-Arroyo’s party Kabalikat ng Mamamayang Pilipino (Kampi), had just left the church on Doña Juana Rodriguez (formerly Broadway) Avenue and was walking back to his car when attacked. Justice Lucas Bersamin, the lawmaker’s younger brother, declined a TV crew’s request for comment.

Bersamin’s murder came more than a month after a relative, Abra provincial board member James Bersamin, 66, was shot dead in the capital Bangued. Family members said the lawmaker had just stood as a sponsor at the marriage of his niece Pia, daughter of Justice Bersamin, to Niño Embuscado and was on his way to the reception when he was gunned down at around 5:25 p.m.“It was the recessional and everyone was going out of the church when we heard gunshots,” said Alvin Salonga, a guest at the wedding.

LUNACY on the Bench is not as common as prime ministers and home secretaries stung by judgments critical of their policies like to suggest.[b] The recent decision of the Supreme Court of the Philippines to dismiss Judge Florentino V. Floro Jr as a judge of the Regional Trial Court in Malabon City because of a “medically disabling condition of the mind” that rendered him “unfit to discharge the functions of his office” repays careful consideration by any student of the judiciary.

Judge Floro first applied for appointment to the Bench in 1995. The mandatory psychological evaluation by the Supreme Court Clinic Services (memo to the Lord Chancellor: do not even consider this) revealed “evidence of ego disintegration”. Judge Floro voluntarily withdrew his application. He reapplied in 1998, but the evaluation was again negative, identifying problems with self-esteem and mood swings. But Judge Floro was allowed to rely on a more favourable assessment from private practitioners. He began work as a judge in November 1998.



The appointment was not a great success. Less than eight months later, the Supreme Court suspended Judge Floro while complaints against him were investigated. It took nearly seven years to complete the inquiries, partly because of the delaying tactics by the judge. In March Justice Chico-Nazario, for a unanimous 14-strong Supreme Court, decided that Judge Floro should be dismissed from the Bench.

In 1890 Mr Justice Stephen became incapable of acting in a judicious manner by reason of mental illness. And in the 1950s, a High Court judge who lost his faculties was persuaded to resign only when no work was assigned to him. But there is, I think, no precedent for Judge Floro’s unusual manner of opening proceedings in his courtroom. A formal, “All rise”, or even a jocular, “Here comes the judge”, might be acceptable. But not the introductory statement to all those present in court that Judge Floro was “a Bar topnotcher” who passed the 1983 Bar Examinations “with an average score of 87.55 per cent”. There would follow a reading from the Bible, after which Judge Floro would answer questions on the scriptural text of the day. The judge’s visiting card also stated that he was a “Bar exams topnotcher (87.55 per cent)” with “full second honours”. As the Supreme Court concluded, litigants might well interpret all this “as a sign of insecurity”.

What caused the Supreme Court most concern, and who can blame them, was Judge Floro’s belief that he enjoyed qualities lacked by other members of the judiciary. Judge Floro is not the first judge to have an inflated opinion of his own abilities, but there are not many who have claimed special powers as “the No 5 psychic in the country”......hehehe! ur funny!

(The Supreme Court judgment unfortunately provides no information on whether the top four also have legal qualifications and, if so, what marks they obtained in the Bar exams.) In a variation of dress-down Fridays, Judge Floro changed from blue court robes to black each Friday “to recharge his psychic powers”. He was, he suggested, the angel of death and able to inflict pain and sickness on people appearing in his court (a valuable but perhaps disproportionate sanction in dealing with vexatious litigants).

The judge believed that he could write while in a trance, and he had, he insisted, “been seen by several people to have been in two places at the same time”, a very useful attribute in reducing the waiting lists for pending cases. Most impressive of all, Judge Floro had made a covenant with “three dwarf friends named Luis, Armand and Angel”, who would, unseen by others, provide him with assistance in court (presumably when counsel were unable to provide a page reference in the bundles of evidence).

Very generously in the circumstances, the Supreme Court emphasised that it was not ruling that Judge Floro was insane. He was merely suffering from a psychosis that appeared to “cloud his judgment” and so undermined his competence and objectivity. Justice Chico-Nazario concluded that psychic phenomena, “even assuming such exist” (a wise judge never decides more than is necessary to dispose of the case), have no place in jurisprudence. Though it would, I suppose, be helpful to be able accurately to predict how the Supreme Court would deal with a case, and so avoid the expense and delay of waiting for their decisions.

The Supreme Court let Judge Floro down from the Bench as lightly as possible. No one is to blame as “we cannot condemn people for their faulty genes and/or adverse environment — factors they have no control over”. Judge Floro “may be dysfunctional as a judge” but “may still be successful in other areas of endeavour”. Especially, of course, as he can rely on the help of those three dwarf friends.

SC Junks with Finality Disbarment Case against Ret. CJ Davide et al.

The Supreme Court has denied with finality the disbarment case filed against retired Chief Justice Hilario G. Davide, Jr., retired Supreme Court Justice Bernardo P. Pardo, and nine others by a Regional Trial Court Judge who had been separated from service due to “a medically disabling condition.”

In a resolution, the Court said that former Judge Florentino V. Floro, Jr. of the Malabon City RTC Branch 73 failed to present any substantial argument to warrant a reconsideration of its September 20, 2006 resolution dismissing for lack of merit Floro’s disbarment complaint.

Floro had accused Davide et al. of conspiring in, among others, the imposition of his preventive suspension for seven years. Also named as respondents were retired Court of Appeals Justice Pedro A. Ramirez, former Solicitor General Alfredo L. Benipayo, retired Assistant Court Administrator and SC Public Information Office Chief Atty. Ismael G. Khan, Jr, Court Management Office Chief Atty. Thelma C. Bahia, Judge Benjamin M. Aquino, Jr., and lawyers Teresita Cruz-Sison, Mary Jane Dacarra-Buenaventura, Esmeralda Galang-Dizon, and Mario E. Ongkiko.

In March last year, the Court ordered Floro separated from service after medical findings showed that he was suffering from psychosis. It said the judge’s medical condition made him unfit to perform his judicial functions.

In the said decision, the Court clarified that Floro’s the separation from service of RTC Judge Florentino V. Floro, Jr., of the Malabon City RTC Branch 73, is not a penalty. “It is imposed instead upon Judge Floro out of necessity due to a medically disabling condition of the mind which renders him unfit, at least at present, to continue discharging the functions of his office,” it said.

The Court said that Judge Floro lacks the judicial temperament and the fundamental requirements of competence and objectivity expected of all judges. It said that the findings of psychosis by the mental health professionals assigned to his case indicate gross deficiency in competence and independence.

The Court, however, did not disqualify Judge Floro from appointment to any other public office including government-owned or controlled corporations. It said that while Judge Floro may be dysfunctional as a judge because of the sensitive nature of said position, he may still be successful in other areas of endeavor. It noted that the SC Clinic medical report showing Judge Floro’s mental impairment also contained statements and findings in Judge Floro’s favor, such as his high intellectual assets and impressive academic achievements.
The Court also clarified that his separation from service did not carry with it forfeiture of all or part of his accrued benefits. It ruled that as a matter of equity, Judge Floro is entitled to back salaries, allowances and other economic benefits corresponding to three years.

Judge Floro, who was appointed RTC Judge in November 1998, admits to having “psychic visions,” of foreseeing the future because of his power in “psychic phenomenon.” He believes in “duwendes” and of a covenant he had with them. He also said that he can write while in a trance and that he had been seen by several people to have been in two places at the same time. He also likened himself to the “angel of death” who can inflict pain on people, especially upon those he perceived to be corrupt officials. During court sessions, Judge Floro wore blue robes except on Fridays when he wore black robes and a black outfit from head to foot allegedly to recharge his psychic powers.
