India focussed terrorist groups isn't the Wests' concern, however sugarcoated the US State Department's views are against Pak. And with Trump as the President, I see no shit happening. We should prepare for a 2 front war. Isn't that what we should be doing in peace-time? Come to think of it, I read the other day about the Navy's budget cuts. From 12 minesweepers to 2-3 now(?). The economy is in a tailspin. Cultural right wingers are 90% of the BJP, only 10% are economic right wingers. And in that 10%, 7% are economic left wingers.

    Assam govt to file case against organiser of Shaheen Bagh protest

    Addressing a press conference, the state finance minister said that Sherjil Islam was heard saying in an audio clip that the state should be cut-off from the rest of India and taught a lesson.
    Now, law of the land will teach him a lesson.

    They need 15 votes out of 35 to get out of the grey list. This will happen next month ? Nah, because Taliban giving up guns & killing will take time to prove.

    He is tainting the whole protest movement by giving it a sectarian spin. The govt has to act. They then can paint this as political persecution to the west.

    This took some hunting but here is a resolution (pdf) from Jan 22 by the the European United Left/Nordic Green Left (GUE/NGL) Group

    D. whereas the Citizenship (Amendment) Act, 2019 (CAA) was passed by the Parliament of India on 11 December 2019 amending the Citizenship Act of 1955 to provide a path to Indian citizenship for members of Hindu, Sikh, Buddhist, Jain, Parsi and Christian religious minorities who had fled persecution from Pakistan, Bangladesh and Afghanistan before December 2014;

    whereas the CAA leaves out Muslims and others from these countries, as well as Tamil refugees from Sri Lanka, Rohingyas from Myanmar, and Buddhist refugees from Tibet;

    whereas this amendment introduces religion as a criterion for citizenship for the first time under Indian nationality law;

    whereas this amendment violates the secular nature of India’s constitution;



    E. whereas the CAA violates India’s international obligations to prevent deprivation of citizenship on the basis of race, colour, descent or national or ethnic origin, as enshrined in the International Covenant on Civil and Political Rights (ICCPR) and other human rights treaties;

    whereas the CAA is in clear violation of Article 15 of the Universal Declaration of Human Rights (UDHR), which states that ‘Everyone has the right to a nationality’ and that ‘No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality’;

    whereas the Office of the United Nations High Commissioner for Human Rights has called the CAA ‘fundamentally discriminatory’, adding that while India’s ‘goal of protecting persecuted groups is welcome’, this should be accomplished through a non-discriminatory ‘robust national asylum system’;


    F. whereas all states are bound to respecting the human rights of all individuals without distinction; whereas an individual’s legal bond to a particular state through citizenship remains in practice an essential prerequisite to the enjoyment and protection of the full range of human rights;


    G. whereas as stated in the Declaration of the High-level Meeting of the General Assembly on the rule of law at the national and international levels and in the resolution adopted by the UN General Assembly on 30 November 2012, ‘all persons, institutions and
    entities, public and private, including the State itself, are accountable to just, fair and equitable laws and are entitled without any discrimination to equal protection of the law’;


    H. whereas the CAA marks a dangerous shift in the way citizenship will be determined in India and is set to create the largest statelessness crisis in the world and cause immense human suffering;
    That's their argument. It will be tested in the SC in good time.

    The idea here is there will be massive detention camps. If the govt has said nobody is getting deported then they will have to put them some where. They will be documented and given work visas. They are now all trackable. But there is a difference. These people can never vote in the future. So people think the ultimate design of CAA is to disenfranchise these people.

    I. whereas the passage of the legislation caused large-scale protests in India;

    whereas huge demonstrations have been held in the capital, Delhi, as well as in Mumbai, Kolkata, Bangalore and Hyderabad; whereas the CAA has reignited old hostilities in Tripura;

    whereas Assam, Uttar Pradesh and other north-eastern states have seen violent demonstrations against the CAA over fears that granting Indian citizenship to refugees and immigrants will cause a loss of their ‘political rights, culture and land rights’ and motivate further migration from Bangladesh;

    whereas protesters have demanded that Indian citizenship be granted to Muslim refugees and immigrants;
    People in Assam protested the extension of the deadline from the eve of Operation Searchlight as agreed in the Assam accords to the end of Dec 2014.

    Bolded bit is what these EU reps think the goal of CAA is. That no muslims will be granted citizenship in India after 2014. Hasn't the FM already mentioned the number of muslims that have got citizenship. Hasn't she said that muslims can still apply for citizenship in the future.

    Q. whereas trade negotiations are underway between the EU and India;
    1. Expresses deep concern at the fact that India has created the legal grounds to strip millions of Muslims of the fundamental right of equal access to citizenship; is concerned that the CAA could be used, along with the National Register of Citizens, to render many Muslim citizens stateless;
    If they're illegal and Bangladesh won't accept them then they will indeed become stateless. That is until a future govt passes yet another citizenship amendment to accept them. The end goal of NPR, CAA and later NCR i have to believe isn't disenfranchisement but to discourage future illegal immigration primarily from Bangladesh. Save the NE in effect.

    8. Urges the Indian authorities to accept visits from UN Special Procedures, in particular the UN Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, the UN Special Rapporteur on the rights to freedom of peaceful assembly and of association and the UN Special rapporteur on extrajudicial, summary
    or arbitrary executions;
    Given my radical position on freedom of speech i'd be in support of this eight point. Would not apply to disturbed areas but rest of the country is fair game.

    Have we been blocking the UN Special Rapporteur from UN Special Procedures ?

    10. Calls for the EU and Member States to promote the implementation of the UN Security Council resolutions on Kashmir; calls on India and Pakistan to consider the enormous human, economic and political benefits of resolving this conflict; expresses deep
    concern at the growing tensions between India and Pakistan, both being nuclear weapon states, which have been further fuelled by the controversial decisions of the Government of India on Kashmir and citizenship; condemns the unilateral changes made to the status
    of Kashmir by India; asks both sides to implement the recommendations of the UN Refugee Agency (UNHCR) report on Kashmir;
    Underlined bit is a pipe dream unfortunately. India more than any one else already realises the enormous human, economic & political benefits from resoiving this conflict.

    11. Urges the EU and Member States to raise the controversial new citizenship legislation in their contacts and negotiations with their Indian partners, and insists that any EU trade agreement with India should include a strong human rights clause with an effective implementation and suspension mechanism;
    India will never agree to a trade agreement with such a clause.

    India has little to worry if the European Parliament passes the six draft resolutions on Citizenship Amendment Act and Kashmir by putting them to vote. Actions taken by the independent body are “not legally binding”, multiple sources told ThePrint.

    The Strasbourg-based European Parliament is an independent body and resolutions passed by it are only “handed over to the European Commission” for its consideration, a diplomatic source said.

    The source also said it is entirely the decision of the European Commission whether or not to take the resolutions seriously.

    Meanwhile, according to sources in the government, India has already activated diplomatic channels to ensure the European Commission does not act on it, and urged a comprehensive dialogue on the issues of Citizenship Amendment Act and Kashmir.
    The problem is optics, makes dealing with the Euros harder.

    European Parliament will take up resolutions opposing CAA | HT | Jan 27 2020

    The European Parliament is expected to take up six resolutions on India’s Citizenship (Amendment) Act this week, with the two largest groups of its members strongly criticising the law for its negative consequences for internal stability and potential for creating a “statelessness crisis”.

    It remains to be seen whether the resolutions will be taken up separately on January 29 as efforts are underway by the six groups to reach a compromise on the text. A representative of the S&D Group said: “Other political groups have tabled different resolutions and in this case, you could expect some compromise around a single text in the coming days.”
    So its not the final text but they will come up with just one that they agree with. Let's see how good their fact checking will be. I'm expecting better than the crap the Labour party passed at their conference.

    Who are these groups

    The European People’s Party (EPP) Group, a centre-right group that is the largest with 182 Members of the European Parliament (MEPs), said the CAA “is selective and excludes Muslims from provisions provided to other religious groups” and expressed concern about the “wide range of negative consequences that it might have for India’s international image and internal stability”.


    The Socialists and Democrats (S&D) Group, the second-largest group with 154 members from 26 EU states in the 751-member parliament, was especially scathing in its resolution, which expressed “deep regret over the adoption… of the CAA, which is discriminatory, dangerously divisive and may potentially create the largest statelessness crisis in the world”.


    The Renew Europe Group, a liberal group with 108 MEPs from 22 countries that is the third largest group in the European Parliament, said the CAA is “explicitly discriminatory in nature as it specifically excludes Muslims from access to the same provisions as other religious groups” and condemned its adoption.


    The Verts/ALE Group, which is the fourth largest group with 75 MEPs from 16 countries, said in its proposed resolution that the CAA, “combined with the nationwide citizenship verification process, will leave India’s 200 million Muslims with the challenge of proving Indian nationality or becoming stateless” and urged Indian authorities to “immediately amend the provisions [of the law] in accordance with international human rights standards”.


    The GUE/NGL Group, which has 41 left-wing MEPs, criticised both the CAA and the security shutdown and detentions in Jammu and Kashmir, and expressed “deep concern… that India has created the legal grounds to strip millions of Muslims of the fundamental right of equal access to citizenship”.
    All of them are critical about CAA but only two talk about Kashmir, Verts/ALE & GUE/NGL

    A spokeswoman for EU Foreign and Security Policy also clarified that, “The opinions expressed by the European Parliament and its members do not represent the official position of the European Union (EU)."
    The comments came a day after India called for engagement between New Delhi and the EU “to get a full and accurate assessment of the facts before they proceed further" with discussing and voting on the resolutions.
    Former foreign secretary Kanwal Sibal said that should the resolutions be passed, though non-binding, they would affect India-EU ties. “India’s image is taking a beating because of longstanding traditional prejudices in liberal (European) circles," he said.
