    India and the US have an extradiction treaty but my understanding is that the host country must try the alleged in its home courts first, after the punishment is meeted out, then the extradicting country can ask for the alleged back but most provide evidence of the crime.

    The system has been abused. Air India Flight 192 was botched by Canada (a shameful act) and the perputrators are still free because the Canadian Courts cannot used ill handled evidence to convict or extradict.

        The only problem here is that India has no leverage over the US to force them to give up Headley. If the situation were reversed, the US would have arm-twisted the Indian govt. into giving him up long ago.

              On 20 December, the Kerala High Court accepted to temporarily relax bail conditions for both Italian Marines by allowing them to travel to Italy for 2 weeks during the Christmas vacation period. Italy was required to pay a further bond of Rs. 60 million (more than 800 thousand Euros) and keep the Marines under surveillance at all times. The Italian Government submitted guarantees to the High Court prior to taking custody of the Marines and was responsible for their return and surrender of passports to the Kerala High Court before 15:00 IST on 10 January 2013.

              On 4 January 2013, the marines flew back to Kochi airport, "keeping their words of Italians and trusting in justice". On arrival, they surrendered their passports and appeared in front of the court, which on turn gave directions to release the Rs. 60 million bail, and for the marines to appear before it on 15 January, then postponed to 18 February.
              This was a decision made by the Kerala High Court though. Don't think it can be classified as a diplomatic climbdown or something like that.

                Yes, it can. GOI went all out to convince the court that the marines should be let go. The fact that they returned is besides the point, murder suspects don't just get to spend Diwali with their families.

                By the way, I have no beef against the Italian government in this. They did what a country does for its citizen and they even kept their word
