    No refugee status for U.S.deserters according to Canada,s highest Court. Why an American would assume he was a refugee after signing a contract by choice to serve and then act suprised to be posted overseas is bizzare to say the least. As much as I hate our current system of refugee claiment and the ridiculous abuses we let these people get away with, lets be serious here shall we. These are not child soldiers,or people forced to join a Military organization,they voluntarily joined,thus forfeiting any claim of illegality. Any thoughts folks?

    Are we to assume the ruling applies to only enlisted personnel or also to conscientious objectors in the case of a draft? What was the case and what did the court say?

      The court didn't offer an explanation of its decision, which is apparently normal.

          Totally agree. The idea of a refugee is one who fears peril in his own country and so has to flee. If Canada were to assume that a professional soldier who decides the day job is not to his liking is a refugee because the local authorities might want to prosecute him then she is inviting any old criminal or mafiosa who might be in peril for their liberty because of their actions to turn up and claim asylum.

          EDIT : Can you still get the death penalty in the US for desertion?

            The SCC refused to hear the case, thus no judgment was issued.
