LAHORE: Justice Syed Shabbar Raza Rizvi of the Lahore High Court on Monday granted bail to a woman accused of zina on the strength of video evidence.

The court ruled that a video film was not the right kind of evidence to prove commission of zina under Section 10 of the Hudood Ordinance of 1979 and under Article 71 of the Qanoon-e-Shahadat Order of 1984. Four witnesses were required to testify that they had actually seen the offence.

The complainant lodged a case against petitioner at Muridke police station in Sheikhupura district under Section 10 and Section 13 of the Hudood Ordinance. He said that he had rented a compact disk from a video shop showing the woman having sex with two men.

The court said that neither Section 10 of the ordinance, pertaining to zina liable to hadd, was applicable nor Section 13, pertaining to prostitution, was applicable. The movie, it observed, could not be used to prove that the accused had been paid for it.

“In the instant case, the complainant only saw the movie and not the fact,” Justice Rizvi observed.

Also, the FIR did not contain the names of the people who produced the film or hired the woman to perform it.

The court pointed out various techniques could be used to prepare fake or virtual photographs or movies. Unless independent witnesses had corroborated it, the prosecution story could not be believed.

Justice Rizvi said that Article 9 of the Constitution guarantees life and liberty to every person and this liberty cannot be curtailed on the grounds or allegations mentioned in the FIR.

The court also observed that the petitioner was a mother of a suckling baby and Section 497 of the Code of Criminal Procedure favoured her in grant of bail and set bail at Rs 50,000.

I am afraid such things are not discussed there.

While some of the arguments on QTV are bigoted, but with an open mind, one can also learn about why some Islam folks do somethings that otherwise appears difficult to comprehend by the non Islamic folks.

Yet, if one sees QTV with a bigoted mind, then it becomes a whole lot of tripe.

Therefore, it is upto the viewer to use his own judgement.

It is rubbish man. Ever seen Dr. Farhat Hashmi? She's like telling her students how its a good humanly thing to say Salam to not just the people u know but to all passerbys, so a girl all burkha clad, asks her, so that means we can say Salam to the boys passing by too? hahaha she replies, no u can't. It won't be the same thing.

They twist facts, one day they'll drive people away from Islam themselves. Religious teachings are beyond DOs and Dont's. Why not leave those upto human judgement?

I agree, the biggest threat to Islam is not any Hindu,Christian or Jewish conspirators but the so called hardline interpretors of the Koran. they try to dictate the common muslims in everything they do and their ideas. You know for some reason , the reformists and the moderate leaders of any religion are always popular with the Public. (Khatami would be a good example) . Musharraf is moderate leader, but i really dont know if he is popular among the Pakistani people.

Allah is ever Forgiving, Merciful. And, whosoever repenteth and doeth good, he verily repenteth toward Allah with true repentance.” (Al-Furqan: 68-71)
