And I, right now untill proven wrong do not think its about his salary, the amount is to low for that why would he stop at what he as lost upto now? surely he would be seeking total loss of earnings and career.....no as I stated he is getting the attention of defence industries quickly..and there is no quicker way than money...........anyway not repeating myself anymore will wait and see.

Agreed it is all speculation.

Since he is grounded he would continue to draw his base salary but not his flight pay. Perhaps the amount compensates for the difference of the life of his income as flight pay + base as opposed to just base.

The reason why the Major went for $75,000 because I am guessing that this is a diversity case meaning it is a case between citizens between different states and in order to have a diversity case, you have to have a minimum of damages of over $75,000 in order to use the federal court system otherwise he would be stuck in a state court system.

Well, that clears up quite lot, good to have a resident lawyer student, I am sure you will stop advising WAB from that day you are able to charge by the hour..lol

What is your opinion regarding enlisted men bypassing JAG, and taking their grievences to civil courts?

Thanks for explaining the legalities Bm, however personally, I will still give him the benefit of the doubt as a serving officer untill we know otherwise.

He is not a military man. He is a civilian performing his National Guard duties and requirements. So I am not exactly sure how JAG applies to this case.

He's part time military.

The few I know were active duty pilots but got out when they reached the "Fly a Desk" rank.
