VT: Judge Sentences Serial Rapist of Child to a Mere 60 Days Jail Time

    From The Common Voice :

A Vermont judge sentenced a man who repeatedly raped a 6-year old girl for four years to a jail term of 60 days, shocking the entire city of Burlington.

Mark Hulett, who admitted to repeatedly sexually abused a child over a four-year period, got a slap on the wrist in a Vermont courtroom this week and will be free to walk the streets in as few as 60 days, according to the Burlington Free Press.

He sexually assaulted the girl for years, beginning when she was only 6 until she was 10, according to the prosecutor. The prosecution wanted at least an eight year sentence, and says he could have received life in prison.

However, Corrections Department officials said they were unable to provide psychiatric or psychological treatment to Hulett in jail. Judge Edward Cashman then decided to set the jail term at a minimum of 60 days.

Judge Cashman defended his ruling by saying that without treatment, a long jail term would only harden Hulett and make him more dangerous when he is released. He seemed to feel that decision would keep society safer from this offender's sexual deviancy in the long run.

"This judge has got to go. It's appalling that he's so concerned over the treatment of a sexual predator who sexually assaulted a little girl over and over and over again," says former New York City Police Department sex crimes detective Sid Francis, who now runs a private detective agency.

"The people of Vermont have got to dump this judge. He's dangerous," added the decorated cop.

The guy will be back out in the public - completely defenseless - in 60 days.

That's assuming he survives his 60 days of course.

There is more on this here:

I definitely think that this judge should be ousted since he is obviously not in his position to help protect the public.

..."But the judge also was told that Hulett would not get any counseling for the crime until he was released because he was deemed unlikely to offend again."

Wtf does that mean?.....and who "speculates" what he will or will not do in the future. The man not only molested the little girl once, but SEVERAL TIMES, obviously. And they say it is unlikely he will offend again???

    Jesus Christ!

I wonder what the ruling would be if it was the judges daughter the man had been raping for years. That scumbad does not deserve to see the light of day. Neither does the rapist.

That judge needs to be yanked from the bench never to return after a viscious ass beating in front of his own court.

The suspect needs a non stop trip to a shallow grave in the name of deciency to all of those parents whos hearts have been broken by unfixable human trash such as this man irregardless of his age.

Is it any wonder why parents are turned into extreme vigilanties after such hearings by people who use loop holes in the system as an excuse.

Howard Dean was actually quite moderate during his tenure as Governor of VT. He balanced the budget every year he was governor, he was endorsed by the NRA 8 times as Governor, he supported and upheld the death penalty...

Dean swung hard left after he decided to run for president.

Actually, my earlier comments look an awful lot like a threat against a federal court official.

I should probably state now that i was KIDDING.

Yeah I have to agree that even what I wrote could be considered threatening to a federal official. But I mean come on how in the hell can you let somebody like this walk in 60 days. Thats not justice its a travisity there of.

There is no doubt this judge will be ousted....just a matter of time. The State Reps are already passing legislation to deter this kind of travesty. I also don't expect the perp to live long after he is released.

Better, but this man still deserves to be hung in the town square:

Vt. Judge Increases Sex Offender's Penalty By WILSON RING, Associated Press Writer
    39 minutes ago

A judge who was widely vilified for giving a child molester a 60-day jail term imposed a new sentence Thursday, increasing the man's prison time to three to 10 years.

Judge Edward Cashman said he felt he could now impose the longer sentence because the state had agreed to provide treatment to the man while he is behind bars. The state had initially said such treatment would not come until after the man served his time.

Mark Hulett, 34, pleaded guilty to charges that he had sexual contact with a girl during a four-year period beginning when she was 6.

At the original sentencing, Cashman said the best way to ensure public safety was to get Hulett out of prison so he could receive sex offender treatment. Because the Corrections Department concluded that Hulett wasn't likely to reoffend, he wouldn't be eligible to receive sex-offender treatment until he reached the end of his jail term.

After Cashman announced the initial sentence, Gov. James Douglas called for the judge to resign and several lawmakers suggested he be impeached.

Douglas said Thursday he considered the new sentence to be too lenient.

"It's 18 times 60 days, so it's certainly an improvement," said the governor. "Personally I think it's inadequate for a crime of that magnitude, but it is certainly better than the first decision."

In his order Thursday, the judge remained firm in his original belief that sentences must be concerned with more than just punishment.

"The court agrees a punitive response — punishment — is a valuable and necessary component of society's response to criminal conduct," he said. "It is a tool that the court has routinely used for the past 24 years on the trial bench. As stated during the sentencing hearing, however, punishment is not enough of a response in some cases.

"This is one of those cases," he said.

Attorney General William Sorrell had also hoped for longer than three years, but he praised the judge for making the change. "I would have rather seen it be a longer sentence as a message to other would-be offenders, but I think Judge Cashman is big enough to change course," he said.

The victim's family left the courtroom without comment.

Hulett's lawyer, Mark Kaplan, said he thought the sentence was fair, adding, "I think it makes sense under the circumstances."
