    MARYVILLE, Tenn. — A teenager was jailed for nine days after being accused of burning an American flag on the Fourth of July, and he faces trial next month.

    While the case could test a state statute against flag burning — an act the U.S. Supreme Court says is protected under the First Amendment (search) — prosecutors said Andrew Elisha Staley (search) has yet to argue that he was exercising free speech rights.

    "Bottom line is, the kid got drunk," said Lisa Lee, his mother. "He's never been in trouble before."

    Staley, 18, is accused of taking the flag from a residence and setting it on fire. His father said the teenager "has no reason for anger against the United States" and could easily have ignited a garbage can instead of a flag.

    "He was brought up in church, and he knows right from wrong," Doc Staley said.

    Doc Staley said his son has been "floundering around" since dropping out of high school. "This is where the drinking came in. And he's not very good at it," the father said.

    The teenager was released from jail Thursday on his own recognizance while he awaits his Aug. 2 trial on charges of desecrating a venerated object, underage drinking, littering, evading arrest, burning personal property and theft.

    The Tennessee flag-burning statute (search) makes the crime a misdemeanor, punishable by less than a year in jail and up to $2,500 fine.

    My reaction was to be proud of the parents reaction. Instead of making excuses, the father said his son screwed up and needs to get his life back in order. I'm not too fired up over the incident since it sounds like it is the result of being a drunken idiot instead of being a deliberate act of defiance. Hopefully, the jail time will make him wake up to where his life appears to be heading.

    Imagine trying to prove to your folks you're all grown up by drinking, only to have your dad tell the media that. Talk about a bummer...

    If this sort of thing happened in India, the teenager would've been arrested, denied bail and tortured to near death.

    I dont agree with the illegal torture. But burning the country's flag as a deliberate act of defiance must be declared as treason and sedition. IMHO a citizen who burns his country's flag must be shot....

    I agree with your sentiment, although I have a sneaking suspicion that it wasn't him, but Jack Daniels that told him to do it.

    I can't tell you how many stupid, idiotic things Jack has told me to do, unfortunately I spent a lot of time in the past listening to him. Never once have Jack and I even considered burning America's flag. If citizens of other countries want to burn it in some sort of rabid protest, I have no problem with them making their statements and setting themselves ablaze while doing so. But as Americans, as citizens of the US, we should all be a little better than that.
