    Lahore High Court validates 12-year-old’s marriage ( Now Pregnant )

    Looks like the Lahore High Court has decided that it is a tribal jirga after all, certainly against the backdrop of a series of antediluvian interpretations of the law over the past fortnight.

    First we had the Lahore High Court mulling over ruling that accepting video evidence in the absence of 4 Male Muslim witnesses in cases of adultery is “Un Islamic”. alternatively here.

    Second we had the very same Lahore High Court mulling over ruling that accepting DNA evidence in adultery cases to establish paternity is “Un Islamic”

    And now once again the Lahore High Court claims to have struck a blow against the “Un Islamic” and has legally sanctified what in many countries of the world would be termed pedophilia :

    LHC validates 12-year-old’s marriage

    LAHORE: Justice Syed Shabbar Raza Rizvi of the Lahore High Court on Monday validated the marriage of a 12-and-a-half years old girl who had secretly married a man without the consent of her parents.

    Zeenat had married Babar Javed of her free will and her parents lodged a Hudood case against the couple. A report placed in the court said that the girl was pregnant. The couple moved the court to quash the first information report.

    Justice Rizvi observed that a girl can marry a man of her choice after reaching puberty which, he said, starts with menstruation. He did not accept the prosecutor’s argument that under the law, a girl 16 years old at least, would be regarded as “mature”. He said that under Sharia law, puberty starts with menstruation and Zeenat’s marriage was valid because she had married after menstruation.

    He ordered the police to quash the FIR against the couple.

    For those curious the husband is 25 years old.

    I guess what you are saying is that what the Judge ruled is not as he claims sanctioned by Islam, else why would a Muslim “rot in hell” for following what is sanctioned by Islam?

    Please provide a Quranic reference to show this action of the Judge is against the tenets of Islam.

    Any sane person knows that what th judge ruled was sick.
    There is no reason to quote koran here.Its already getting enough rotten treatment .
    What's the difference between people who pray in church and those who pray in casinos?

    What kind of justice system does Pakistan follow? is it a mix up of sharia and the old british system ?

    it's a mix up, our whole justice system.

    We have the british system, which Zia mixed with his own special version of Shariah.

    They dont actually go hand in hand. so I am assuming the Shariah has replaced the British system here.

    no....i don't think even the most wildest talibanized interpretations of Shariah can justify peadophilia.

    Even in Shariah, there are ways of going about marraige...

    i mean this child was willing to marry him, or so he says, but was she capable or responsible enough to make that choice? a 12y/o, i think not.

    The sharia law ignores child marriage IMO. Even prophet Mohammed married Ayesha when she was 12 or 13 IIRC.

    We simply cannot use practices in the dark ages as an excuse to carry out actions that we percieve today as barbarian even if the said practices were carried out by a Prophet.
