    Fired pregnant teacher sues Catholic school

    NEW YORK (AP) -- The New York Civil Liberties Union has filed a federal discrimination complaint against a Catholic school, charging that it unjustly fired an unmarried teacher for being pregnant.

    "I don't understand how a religion that prides itself on forgiving and on valuing life could terminate me because I'm pregnant and choosing to have this baby," Michelle McCusker said Monday at a news conference to announce the suit.

    The 26-year-old preschool teacher was fired last month from St. Rose of Lima in Queens, according to published reports. (Watch what was in her termination letter -- 1:36)

    The Diocese of Brooklyn also was named in the Equal Employment Opportunity Commission complaint.

    "This is a difficult situation for every person involved, but the school had no choice but to follow the principles contained in the teachers' personnel handbook," diocese spokesman Frank DeRosa said in a news release.

    The handbook says that each teacher must "convey the teachings of the Catholic faith by his or her words and actions."

    Lawyers at the NYCLU, which filed the suit on McCusker's behalf, argued that administrators enforced the policy in a way that disproportionately affects women.

    "The school used her pregnancy as a marker," attorney Cassandra Stubbs said. "How do they determine if male employees engage in premarital sex?"

    It's not the first time the NYCLU has argued such a case. In 2003, the unmarried director of an after-school program run by a Catholic charity in Buffalo was demoted when she became pregnant. The equal employment commission found that the charity had violated federal anti-discrimination laws, the NYCLU said.

    That charity agreed to ban discrimination based on marital status or pregnancy.

    I am going to go ahead and agree with the school on this one. Even though, I personally, do not think this woman did something so awful or horrible. The thing is this:

    THe school set rules for her employment. My employer did too when I was hired. We are told not to work for the competition for example. If I were to go get a job at Texaco (sorry, its Chevron now) working part time in the evenings and nights would I get fired? Yes. Yes, I would. Would I whine about it? No. Because I was told, as was she, that this list is what will get you fired. Simple. Easy. No branier.

    She is working as a TEACHER in a CATHOLIC school. What did she think would happen. Does "convey the teachings of the Catholic faith" not mean to obey the 10 commandments?

    How would they prove it if she were a man? If his girlfriend showed up pregnant - CLUE! A kid can only be hid for so long. Eventually, one day, he would slip and mention it.

    They're within their rights. On the other hand, if that's their standard, they should just hire married people.

    The NYCLU is arguing that the Church will be able - 100% of the time - to pinpoint and prove without a doubt, relatively quickly, when a woman is pregnant due to premarital sex. Proving the same for a man is not as certain and thus they are singling out women in this regard.

    Having said that, I agree wholeheartedly that the school is within it's rights to fire her. She is a Catholic schoolteacher, not a secretary or law enforcement officer or whatever.

    Having said THAT, I think the Catholic Church has proven once again what an organization of hypocrites they are in firing her.
    This is the same organization that has hid - for DECADES - priest abuse of children. Once the priest gets caught, they quickly shuffle him off to a new (and unsuspecting) diocese.....usually so he can begin abusing fresh victims.

    But that is not what is at hand here. So what if they are hypocrites (IYO ).

    I am standing by the fact that she was told what would and would not get her fired. She then chose to not abide by those rules. If she were hired to play Ronald McDonald at the local Mickey D's and then decided that she did not want to wear the make up, she would have lost her job. It is discriminatory to "require" someone to wear make up at work, unless it is part of the job. Being a "good Catholic example" is part of a Catholic teachers job. That is why many of those kids are there - so they will have that faith and its boundries instilled into them in their parents absense. She did not do that. She blatantly did the opposite.

    Well now that would be discrimination. There are plenty of single people who choose not to have pre-maritial sex. So to assume that all single people are incapable of abiding by the rules is not the best choice IMO.

    Okay, maybe it is. I know of only one....granted she is in her 40's and has no intention of jumping on the band wagon anytime soon.

    I think the School cannot be faulted.

    And anyway, the world is full of hypocrites but that does not mean that the any rule that governs a country or an isntitution should not be applied.

    One of my old neighbors used to be a priest. He gave up the priesthood so he could get married. The local parish had an extremely difficult time "forgiving" him. Later he became a teacher at the local catholic school. They did not want him, but were desperate for teachers. Six years later he had absolutely zero negetive marks on his record and he had proven to be able to "teach the unteachable" His only mistake was that after two near death pregnancies of his wife and much soul searching, he decided to have a vasectomy. He and his wife told absolutely no one. His catholic doctor however, went straight to the priest and did all the "confessing"(I would call snitching). My neighbor was canned in short order, and just to make sure he could not teach anywhere else, his record was suddenly tainted. My neighbor had the foresight to get a copy of his record before hand and was in time able to have his record returned the way it was before the incident. He then forgave the people who wronged him and is now teaching in a public school. It totally amazes me that the catholic church would rather give up a gifted teacher than to lose control of an individuals reproductive system.

    I know a lot of really good people who are catholics, but the catholic church is messed up. Covering up and protecting the pediphile priest is nothing short of criminal and evil. There is no excuse for that. The church is too power hungery, too money hungery, too arrogant, too out of touch with the people, and the word of God, and lead by hypocrites, to truley fullfill it's mission. Unfortunately many other religions don't fare much better.
