    Kashmir shuts down over CBI's Shopian murder conclusions

    Srinagar At least 12 people, including two policemen, were injured on Tuesday as violent clashes between groups of youth and police rocked different parts of Kashmir valley during a strike to protest the CBI report in the Shopian case.
    The clashes erupted at nearly a dozen places in Srinagar, two places in North Kashmir's Baramulla and South Kashmir Pulwama town when police stopped hundreds of people from taking out processions.

    The strike was called by NGO Majlis-e-Mashawarat, Shopian, against the CBI, which filed its final report in the case before the Jammu and Kashmir High Court yesterday.

    Ruling out rape and murder of 17-year-old Asiya and her 22-year-old sister-in-law Neelofar, the CBI attributed their death to drowning on May 30. The agency also filed a chargesheet against 13 persons including doctors and lawyers for allegedly fabricating evidence.

    Chanting anti-CBI slogans, groups of youth took to the streets at a dozen places in Srinagar including Bohrikadal, Eidgah, Batmaloo, Natipora, Kawdara, Jamia Masjid, Maisuma, Qammerwari and Barzalla and pelted stones at security forces deployed in strength to maintain law and order.

    Police used batons and teargas to control the crowd, the sources said, adding four persons were injured in the clashes.

    Inspector General of Police Kashmir Farooq Ahmed said the situation was under control. "Stray incidents of stone pelting were reported from some areas but the situation was well under control".

    Shops were closed but transport was plying in some areas.

    At Bohrikadal in old city, fire broke out in a house during the clash and efforts are on to douse the flames.

    Locals alleged that the fire was caused by indiscriminate teargas shelling by police. However, police denied the charge.

    A spokesman of the fire department said efforts were on to control the fire. "It is premature to say what caused the fire".

    The sources said eight persons, including two policemen, were injured as intense clashes were oing on at Cement Bridge in Baramulla and Hathi Shah in Sopore town, 55 kms from here.

    Groups of youth also clashed with police in Pulwama district town, 32 kms from here, but there was no report of any casualty, the sources said.

    The sources said hundreds of people shouting slogans against CBI took out a march in Shopian town, 52 kms from Srinagar.

    However, the protestors dispersed peacefully after visiting the house of the deceased women and assured full support to the family.
    I have been following the Shopian case and I have more faith in the forensic examination conducted by the CBI. Seems the Kashmiris have an agenda of their own and we even have government servants, lawyers and even doctors who collaborated to use the death of the women to demonize the security forces. The Kashmiris have been having it good for a long time. Inspite of the insurgency, the poverty rate in Kashmir is one of the least in India.

    My question is how should India deal with separatism in Kashmir without losing any real estate ?

    Srinagar The opposition Peoples Democratic Party on Monday dismissed the CBI findings in the Shopian case, which attributed the deaths of the two women to drowning, calling the probe fixed. “The investigation by multiple agencies, one after the other, was aimed at shielding the culprits rather than bringing them to book,” PDP chief Mehbooba Mufti said. “It now appears all the investigation was done to prove as true the initial verdict of drowning by Chief Minister Omar Abdullah.”
    The Majlis-e-Mushawarat that has been spearheading the agitation in the Shopian case has also rejected the CBI findings, submitted in the J&K High Court.

    “It is a 68-page report and we have not gone through it yet. We will raise our objections only once we go through it,” Mohammad Shafi Khan, the spokesman of the Majlis, said. “But the conclusion drawn by the CBI that the two women died because of drowning is not acceptable to us.”

    In a statement issued on Monday, Mehbooba said, “The inability of the government to properly investigate the death of the two women will not only define for all times the Omar Abdullah government but would further erode the faith of the people in institutions of the state at local and central levels.” She hoped the HC, “the last hope of the people”, would ensure that justice is done to the family of the victims.

    The Majlis claimed that the lady doctor who prepared the vaginal swabs of the two women had admitted before its members and the CBI team that the samples were fake. But, he added, “in the presence of our members, she told the CBI she reiterates that sexual assault took place. She told them that gyanaecological examination confirmed rape”.

    The Majlis was formed soon after the death of 22-year-old Neelofar and her sister-in-law Asiya Jan in mysterious conditions. It was alleged that the security forces had a role in the “rape and murder” of the two. On the call of the Majlis, Shopian had remained shut for 47 consecutive days, demanding justice for the women.

    The Majlis has already “regretted” cooperating with the CBI in its probe. The investigating agency had exhumed the bodies of Neelofar and Asiya in the presence of the Majlis as part of its inquiry.

    Mehbooba felt it was ironical that the family, witnesses, lawyers and “those who wanted justice” found themselves in the dock now.

      Srinagar Giving a clean chit to four police officers arrested in the Shopian case that rocked the Valley this summer, the CBI today said that the two women who were alleged to have been raped and murdered had died due to drowning.
      The agency filed a chargesheet against 13 people — six doctors, five lawyers and two civilians — for allegedly fabricating evidence and misleading people and said the four police officers must be discharged “since they are not liable for any criminal prosecution”.

      CBI counsel Anil Bhan informed the High Court division bench headed by Chief Justice Barin Ghosh that the women, 22-year-old Neelofar and 17-year-old Asiya, had drowned in a stream.

      “It is a case of drowning. No rape or murder,” Bhan said, adding that investigations showed presence of soil and water in the lungs of the victims which was later traced to the Rambiyar stream where their bodies were found. “The investigation is now closed.” This was later corroborated by CBI DIG Satish Golcha.

      The CBI chargesheet underlined the mishandling of the case by the Omar Abdullah government and the one-man Jan Commission which went after the four Shopian police officers — SP Javed Iqbal Mattoo, DSP Rohit Basgotra, Inspector Shafiq Ahmad and Sub Inspector Gazi Abdul Kareem-who were arrested on the charge that they allegedly tried to destroy evidence. The CBI investigation found nothing adverse against the police officers.

      A chargesheet has been filed against six doctors — Nighat Shaheen, Gulam Qadir Sofi, Maqbool Mir, Gulam Mohd Paul, Bilal Ahmad Dalal, Nazia Hassan — for allegedly framing an incorrect document and for fabricating evidence with intent to procure conviction of capital offence. They were also charged with preparing false vaginal slides.

      Lawyers named in the chargesheet are Mushtaq Ahmad Gatoo, Muhammad Yusuf Bhat, Altaf Muhammad, Sheikh Mubarak and Abdul Majid Dar. Along with two civilians Ali Muhammad Sheikh and Zahoor Ahmad Zargar, they have been charged with inducing, assaulting and threatening witnesses to make false statements implicating the police and security forces in a false case of rape and murder.

      The family of the two women and the Majlis Mushawarat, which had been spearheading the Shopian case campaign, rejected the CBI findings. They even prevented the CBI from making a powerpoint presentation of the investigation in open court — this was later shown before the media. Chief Minister Omar Abdullah refused comment, saying the government was yet to see the CBI report.

      This is what the CBI chargesheet says:

      * No evidence has come on record to substantiate charges of rape and murder. The death of Neelofar Jan and Asiya Jan occurred due to asphyxia as a result of antemortem drowning.

      * The Shopian team of doctors falsely mentioned in their postmortem that Asiya’s hymen was torn. The AIIMS team found Asiya Jan’s hymen intact, nothing suggestive of penetration.

      * In case of Neelofar Jan, the AIIMS team found no injury on her body suggesting a struggle during rape or attempt to rape.

      * The earlier postmortem falsely mentioned sexual assault in case of Neelofar and falsely mentioned, in case of Asiya, haemorrhagic shock due to bleeding.

      * The investigation established that the six doctors conspired to defame, discredit and cause injury to police and security personnel and get them wrongfully convicted of a capital offence by creating false reports and fudging glass slides said to contain vaginal smears.

      * The five advocates and two civilians induced, assaulted and threatened witnesses to make false statements implicating the police and security forces in a false case of rape and murder.

      * On the four arrested police officers, investigation disclosed that their (police) findings of drowning and carrying out of inquest proceedings were justified. The investigation did not reveal malafide on their part and since they are not liable for any criminal prosecution, they ought to be discharged.

        i just want to know what excuse does the indian government give for not banning and arresting anti india groups like hurriyat etc?
