Death penalty isn't murder. Notice, killing someone is not murder. For example, if some pulls a gun on you and you shoot them first, this is not murder. Thus, clearly killing someone is not always murder. So what's the difference between killing someone and murdering someone? In my mind, murder has two elements, intent and justifiability. Obviously, you can't murder someone if you didn't mean to do it. What you did may be a crime, in the case of negligence for example, but it is not murder. The second element asks the question: "Were you justified in killing the person?" In order for you to answer this question you must answer another--Did the individual deserve to die?--because if a person does not deserve to die then they don't deserve to be killed. If you believe that people should be punish for the crimes they commit, the only question is whether the death penalty is too harsh a punishment. Since you took someone else's life intentionally and without justification, it is hard to imagine a punishment that is too harsh. Therefore, the death penalty is not murder.
