While I agree with your sentiment I believe business owners would have problems trying to enforce a ban on smoking if there is not some supporting legislation that allows them to do so. I also expect that many business owners secretly support the banning of smoking in their establishments as they do not have to confront the issue head on and deal with upset patrons.
